2010 Adult-Oriented Establishments

  • Under the Tennessee Adult-Oriented Establishment Registration Act, two adult-oriented establishments cannot operate in the same building or structure even if they have separate entrances, addresses, electric meters, and licenses. Opinion No. 10-15 (February 17, 2010).
  • Members of an adult-oriented establishment board are appointed by the county mayor, not the county legislative body. If members of the board are improperly appointed and do not voluntarily resign, the district attorney may bring a  action to remove them. The county mayor would appoint persons to the vacant positions to serve the remainder of the term.  Once members have been properly appointed, the board may vote to adopt, modify, or reject the actions taken by the prior improperly-appointed board.  Opinion No. 10-16 (February 17, 2010).
