2012 Open Meetings

Allen v. City of Memphis, 37 TAM 26-17—Property owners bordering area annexed by city brought declaratory judgment action against city alleging open meeting violations relating to the annexation hearings. The Court found that the plaintiffs were really alleging procedural defects in the annexation hearing process, and thus, the plaintiffs should have filed a quo warranto action rather than filing suit seeking a declaratory judgment (May 10, 2012).
