2009 Jails

  • Jones v. Bedford County, 35 TAM 3-6—Inmate sued the county for negligent supervision and for damages relating to an alleged sexual assault by a corrections officer.  The trial court granted the county’s motion for summary judgment as to the negligent supervision claim and the inmate appealed.  The issue on appeal was whether the county was on notice of the foreseeable risk of the sexual assault.  The inmate argued that the county was on notice because the officer’s supervisor had heard the officer make many crude and sexual remarks to the inmates.  The Court of Appeals found that this was not enough to put the county on notice and thus, the grant of summary judgment was upheld (December 15, 2009).
