2012 Condemnation

  • City of Cookeville v. Jackson, 37 TAM 7-5—City obtained certificates of public purpose and necessity from the state for an industrial park and business park pursuant to T.C.A. § 13-16-207.  City then sought to condemn property to be used for sewer system to serve parks.  Homeowner challenged condemnation of property arguing that city did not comply with the industrial park statutes in that city did not identify property to be condemned in obtaining certificates of public purpose and necessity.  Trial court agreed and city appealed.  Court of Appeals affirmed holding that T.C.A. § 13-16-207 required city to identify specific property to be condemned for development of industrial park before obtaining certificates of public purpose and necessity from the state (January 19, 2012).
