2004 Vacancies

• Where the act levying a hotel-motel tax provides for imposition of a civil penalty upon operators for failure to collect or remit the tax, the tax collector should impose and collect the penalty in the same manner as the tax.  Court action is not necessary.  Opinion No. 04-116 (July 20, 2004).
