2010 Records

  • An educational institution, including a county school system, is not prohibited by the Family Educational Rights and Privacy Act (FERPA) from sharing criminal incident report data with law enforcement, and under most circumstances would not be prohibited by the Health Insurance Portability and Accountability Act (HIPAA) from sharing such information with law enforcement.  Confidential information regarding minor children may be shared between law enforcement officers and juvenile courts when necessary for the discharge of their official duties.  Opinion No. 10-70 (May 21, 2010).
