2004 Records

• Under T.C.A. § 10-7-123 an official who provides remote electronic access to records is required to provide remote electronic access to all members of the public for a uniform fee.  Opinion No. 04-114 (July 19, 2004).

• Public Chapter 175 of the Acts of 2003 amended T.C.A. § 40-32-101 regarding expungement of criminal records to provide that expungement of the records in a criminal case would not be available when the defendant is convicted of any offense or charge in the case. This amendment applies to all expungeable cases and not just to sexual offenses.  Opinion No. 04-024 (Feb.12, 2004).
