2003 Records

This opinion discusses the application of Tennessee’s open records laws to private non-profit entities (in this case, Tennessee School Boards Association) in light of the recent Tennessee Supreme Court decision in Memphis Publishing Co. v. Cherokee Children and Family Services, Inc. Unlike Cherokee, TSBA’s records are not public. Cherokee’s records were rendered public by the terms of the contract between Cherokee and the Department of Human Services. Opinion No. 03-042 (April 14, 2003).
