2006 Planning & Zoning

  • Under Tennessee zoning laws the term “use permitted on review” refers to a use of land that is allowed under the applicable zoning ordinance only after the owner obtains a permit. If a county establishes a “use permitted on review” classification, it must establish objective standards for evaluating applications for such uses.  The planning commission may be authorized to impose conditions on the use as long as the conditions fall within the authority and discretion granted in the ordinance.  Whether a use permit may be revoked after it has been issued depends on the circumstances.  Opinion No. 06-142 (September 19, 2006).
