2003 Open Meetings

  • A joint economic and community development board acting under T.C.A. § 6-58-114 is subject to the Open Meetings Act.  Opinion No. 03-091 (July 24, 2003).
  • Because the Economic Development Board of Unicoi County was not created by either the city or the county and because neither plays any role in its operation, it appears that the Board is not a “governing body” under the Open Meetings Act.  However, because the Board includes two members of the Unicoi County Commission and two members of the Unicoi Board of Mayor and Aldermen, which are governing bodies within the meaning of the Act, to the extent that in the course of Board meetings members of either of these bodies deliberate toward county or city business, respectively, they may have violated the Open Meetings Act as it applies to those bodies.  Opinion No. 03-063 (May 14, 2003).
