2008 Conflicts of Interest

  • A school board member cannot serve as a substitute teacher in the same school system, even it is through a third party contractor.  Opinion No. 08-180 (December 1, 2008).
  • The same individual may not run for the offices of county commissioner and constable in the same election. While the statutes do not directly prohibit a constable from being nominated or elected to the county legislative body at some other time, in counties where the county commission can abolish the office of constable or remove their law enforcement powers, a court would probably find that these two offices are incompatible at common law.  Opinion No. 08-177 (November 20, 2008).
