2008 Annexation

• Cities and counties may make binding agreements to refrain from exercising the power to annex and other related powers, but such agreements may be terminated by either party after the agreement has been in place for five years, regardless of changes in the law subsequent to the original agreement.  Opinion No. 08-50 (March 11, 2008).
